Biting The Bullet
Holding It Own
Samui continues to develop and witness massive investment.

Don’t be fooled by the seemingly adverse statistics regarding visitor numbers to Samui. Of course, the number of tourists has declined this year and anyone who thought they wouldn’t is either incredibly optimistic or very naïve.

All of the reasons for the decline are universally shared and have no specific relation to Samui. People are not avoiding travelling here because there’s something wrong with Samui. Far from it, the fact is that the number of travellers in general is down for most places around the world. The fear of getting caught up with protests, terrorist attacks, or swine-flu all deter tourists, but most significant is the fact that many people simply have less money to spend on travel.

Samui’s success or failure as a resort destination, and the island’s future, cannot be judged on one or two bad years; especially when the causes are independent and completely beyond the control of the island.

It’s not just tourism. Some property investors will also be more wary about where they place their money and therefore all real-estate markets throughout the world are likely to experience a slowdown. This is not a sign that the property industry is over. It’s just a blip from which all industries associated with Samui will recover.

In fact, this is one area where, if you delve a little deeper, you’ll realise that Samui is actually still performing very well. If you look beyond all of the negativity and consider the facts, Samui continues to expand its development in many areas, even in this difficult period.

If there’s anything that epitomises the confidence in the future of the island it’s in real-estate investment and even now during these tough times there are billions of baht being poured into the island in terms of residential construction, resort construction and infrastructure improvements.

The last year or so has seen the opening of a number of high profile resorts, such as: Melati, Silavadee, Nora, Bhundari, X2, Four Seasons, Destination and Ibis. And during the next year or so we’ll see the arrival of other hotels and international groups, such as: Conrad, D2, Banyan Tree, Mercure, Starwood, Langham, Lalit, Minor, Best Western, Muang Samui and Absolute; the list is almost infinite. And other hotels, such as the Ban Taling Ngam Resort, have invested heavily in renovating their properties to continue attracting new and return visitors.

Such massive investment hardly suggests doubt in the island’s future. To add to this impressive private investment from local and world renowned international corporations, the Thai government is now also taking an interest and seeking to realise the island’s full potential.

A whopping Bt 900 million has been allocated for improving the infrastructure on Samui to help the island deal with the expected number of future visitors and also to attract more residential real-estate investors. The clear evidence of major road improvements and better drainage can be seen all around the island. And plans are in place for a large government-sponsored conference centre to be built which will enable Samui to attract larger exhibitions and events.

The island’s facilities and services are also continuing to expand despite the current slowdown. High-profile beach clubs, such as Nikki Beach and Beach Republic, have opened to attract high-end, big spending tourists looking for luxurious beach club options. And there are signs at more grass-roots level, too, that the future looks bright. Other industries and services are opening up to cater to the expected increase in foreign residents and home owners.

Index Living Mall will be arriving soon to add to the growing number of furniture and home-ware stores; more vets and animal clinics are appearing around the island; new companies like Creature Comfort Samui have been set up specifically to look after pets in their own homes when foreign residents need to leave the island; there are more landscape gardeners, pool-cleaning companies, home maintenance services, lawyers with western staff, accountants and so on. Samui isn’t just holding its own in these areas, it’s actually progressing and moving forward in anticipation of the future.

Another very prosperous industry on the island is weddings. Samui is rapidly becoming one of the hottest destinations in the world in which to get married and many hotels are offering wedding packages to benefit from this popularity. Such is the demand, that specific wedding operators like Faraway Weddings have grown considerably as the number of weddings they handle per year has almost tripled in the last 12 months. Faraway Wedding’s appearance at the ‘National Wedding Show’ in the UK in October can only assist in promoting the island further.

So what is it that makes the government and all these companies, small and large, have such confidence in the island’s future? Well, most of the reasons are fairly obvious. Take a quick look around and you’ll immediately see the island’s natural beauty. The way in which the island has developed has been more sympathetic to the environment and more focussed on retaining that beauty than in many other resort areas. And the improvements and expansion to the airport also ensures that a higher volume of visitors can be handled efficiently.

Samui benefits enormously from return visitors. And any hotel or villa complex will confirm that many of their guests return year-after-year and stay in the same hotels or in the same areas. It’s remarkable how many tourists have actually been here before and have been unable to find a more suitable, enjoyable or cost-effective alternative anywhere else.

The island has undoubtedly changed in many ways and it will continue to do so. However, the atmosphere which has attracted so many people over time has remained. For the people who arrived in the early years, the attraction of the nature and unspoilt beauty were significant factors which encouraged them to return. But even now after extensive development the majority of first-time visitors are finding that the overall package on offer, with a large choice of accommodation, entertainment and food options, when combined with the island’s natural charm and ambience, Samui provides an unbeatable holiday experience.

So, the evidence of the continuing large-scale investment would certainly suggest that Samui is more than holding its own and that now is actually a good time to be involved in anything associated with the island.

How to find ‘easy to rent’ property investments
This article looks into how easy it can be to find the right property investment which are easy to rent.
Interested in the property investment market? Making the decision to invest is just one step of your journey… the next is finding the right property to make your property investments work.

So where do you start? To help you on your way, here are a just few quick tips to make your journey easier and fun:

Talk to rental agents – as an agent who handles a large number of buy-to-let properties, they will know what your future tenants could be looking for, plus can provide you with an insight into how popular the area is and if it is worth pursuing.

Read a newspaper – scan over the property section and you will soon get an idea of which properties are more popular than others. If a particular type of property pops up often… invests… invest… invest.

Know your market – if for example you find an area that attracts a lot of senior citizens, then a one level rental accommodation or a property that has all its living areas on the ground floor will be more appropriate. Make their needs your top priority.

Read real estate magazines – keep a watchful eye on what the writers focus on. If they mention one item regularly, then it is likely that there is a demand for that type pf property. For example if they keeping writing about single let apartments – in a positive way of course – then find an area that will provide you with the tenancy and fulfil this need.

Location – a property that is situated close to area attractions and local shops/ supermarkets can equal easy accessibility for your tenants, and make the area as a whole more appealing.

Appearance – if you plan to renovate before you rent, pick a property that is reasonably well maintained. A property that looks shabby will turn your tenants away and they will look elsewhere for a more suitable rental property. But if you opt for a property that has minimal repairs, you can potentially find your tenants straight away.

Homeowner’s insurance- I know you’re wondering - how will this affect me? I won’t be living there? It does matter. By getting a quote and informing the agent you plan to rent your property, you can account for any special recommendations for landlords before you invest too much money into the property.

Accountant – it’s important from the start that you verify what the realistic income your property can generate is. With the right figures you can work out the cost of possible maintenance fees compare the work to properties purchase price and see if your property is worth investing before you part with any of your money.

Property Manager - If you’re planning to invest in numerous properties you may need to consider hiring a property manager. They can help you deal with tenants, rent and general property maintenance, whilst enabling you to explore your property investment options elsewhere.

By keeping these points in mind, researching your properties thoroughly and always being aware of your tenants needs, you can maximize your investment opportunities and receive easy long term profits – for life.

One of the keys to being a successful landlord is finding profitable rental properties. There are many different steps to take in your search for the perfect rental property. Here are a few to get you started on the path to success.

1. Find the right broker. A reputable

real estate agent or broker can mean the difference between a successful hunt for a rental property and coming up empty. He or she should know the neighborhood well, and advise you on which properties are best suited to your needs. This is especially important if you are looking for properties out of your current town or area. His or her knowledge of the area can be invaluable.

2. Get your finances in order. Go through your finances thoroughly, and make sure they are all in order. If you plan on taking out a mortgage to finance your property purchase, make sure your credit report does not contain any inaccuracies. Get copies of your credit reports from the three major credit bureaus, and question anything that appears inaccurate. This can help your chances of getting approved for financing, and qualifying for favorable interest rates. Also, come up with several worst-case scenarios before finalizing your decision to buy a property. If you can't find enough renters to fill the property, you'll still have to make your mortgage payments.

3. Do not overpay. Your purchase needs to allow for a sufficient profit margin, even if you don't have full occupancy on your rental property. Set a maximum amount that you can afford to spend, leaving you with some cushion in case you have vacancies.

4. Do not get stuck with a fixer-upper. While finding a cheap fixer-upper may seem like a bargain, you may get stuck in a money pit very quickly. If the repairs are major and would require a lot of time and effort, you may be better off paying a little more for a property that's in better condition.

5. Get it inspected. Before purchasing any rental property, have it thoroughly inspected. Make sure that the electrical wiring is up to code, that the paint is not lead-based, and that the environment is safe for tenants. Inspections can dig up hidden problems that could end up costing thousands of dollars. Although you may be required to pay for the inspection yourself, it can save you lots of money when compared with paying for unexpected repairs.

6. Research the neighborhood. After you have found the right property, take some time to research the neighborhood. Is it safe? Do you need to provide additional security? Are there plans in the works for construction that might lower the property's value? You need to know what the neighborhood is like now, and what it will be like in the future.

7. Know the real estate market. If you're not familiar with the area, or if you're not working with an agent or broker, you'll need to research the current real estate market. Low prices in the housing market typically mean that the rents are also low. High housing costs mean that you'll be able to charge more because the area is in demand.

8. Network. Ask your peers, and people in the area in which you're looking for property, if they know of anything that's available or may become available. Often, business owners and other landlords are on top of the turnover situation, and offering small finders fees as a reward can inspire them to think of you when they hear about a property that may be up for sale.

9. Do not stray too far in your search. While you may not be able to find appropriate rental properties near your current location, do not settle for something that fails to meet your specifications. If you end up with a property in another state or far away from your home, you'll have to either spend money on travel expenses or hire a property manager.

10. Do a Competitive Analysis. Ask your broker to provide an analysis of comparable properties sold in the last two years, listing rental income, sales price, number of units, square footage, and other relevant factors.

In the second quarter of the year RICS reported the sharpest declines in global commercial property rents in the survey’s five year history, with Singapore, Ukraine, Spain and Ireland leading the way.

New Delhi: Royal Institution of Chartered Surveyors (RICS) Global Commercial Property Survey released in India reveals that despite some improvement in the economic data and a moderation in the pace of decline in capital values in all world regions, rental expectations have deteriorated further. In the second quarter of the year RICS reported the sharpest declines in global commercial property rents in the survey’s five year history, with Singapore, Ukraine, Spain and Ireland leading the way. The decline in capital values eased during the second quarter driven by more modest falls in some emerging markets with China and India out in front. Eight percent more surveyors reported a fall than a rise in capital values in China, up from 49 percent in the first quarter.

Property Rental Requires Research.

Various kinds of properties can be rented out. You will need it for residential or official purposes. Then you have other rentals such as for storages and so on. No matter what kind of rental you are looking at, you will need to do some research. Some of the property owners will be away and there will be caretakers who are looking after the needful.

You will have to cultivate a knowledge of the current property rates. They will differ from area to area. Thus, you will have to do a great deal of looking around. You will need to keep all the rates in mind at all times. In this way, you will know best and will not need to look to someone else for advice.

The rentals will naturally differ with the types of properties that are available. This will be the most important factor, especially for residential purposes.

Now, if you want to find a good property, you need to find an agent. There will be plenty of agents in the area. But there will also be the need to choose the right agent. You will have to use the ones who do not hike up the prices according to their whims and fancies. But look out for agents who charge reasonable amounts.

Some real estate agents may not be very reasonable with what they charge. They may try to con you into paying them more on the pretext of signing up good property for you. Stay away from such agents. Try and make use of only the more reputed ones. You can get one through your friends as well as family members, as they will know trustworthy ones.

Remember to also plan out your budget in great detail. You should not be too extravagant if you have some savings. You should try and ensure that you will be able to shell out only so much as rent every month. You should insist on meeting the property owner. I am sure you would not want to end up with a fake deal.

Reading every clause of the agreement will be important, when you are signing up any property for rent. If you do not do so, you may be in trouble if you are not pleased with some of the terms during the duration of the lease.

Remember that finding the perfect place will also be rather time consuming. This is unless you know someone who can help you personally. These days, more and more people have taken to looking for property on the Internet. The Internet offers you plenty of options. You will be able to get all the latest updates. You will have all the categories online. So you need not look anywhere else either. This will be ideal for people who do not have time to look around.

Searching through the Internet will also be very easy. After all, everybody is net-savvy these days. Moreover, you will have listings with pictures. Thus, in a way, you will be looking through a range of options from the comforts of your home.

Tax Deduction on Immovable Property - The New section 13

If you often read these articles, you will know that the old section 13(ter) has expired. Until recently, this was the only section which allowed owners of residential property, which was used for trade purposes, to get tax deductions on the cost of immovable property. This section was effectively repealed on 20 October 2008.

The good news is that there is a new section in place now which seems to be a lot better overall for owners of new, residential units. Section 13(six) effectively came into place on 21 October 2008.

Tax Deduction on Immovable Property - Section 13ter Repealed

Last year, we published an article regarding Section 13ter of the income tax act (Income tax act 58 of 1962) . At the time, this was the only section available to property investors that hold residential property. The section allowed investors to claim tax deductions in respect of the value of the property.

At the time, the section stated the following, in short:

A Taxpayer can deduct from their income, an allowance in respect of the cost of any residential unit which is part of a housing project. The deduction allowed is equal to:

* Ten percent deductable in the first year five or more units are rented or occupied
* Two percent in the first year and every year after that

The section was however very specific about the definitions of “housing project” and “residential unit”.

Housing project:

Had to be any project for the ERECTION of a building or several building in South Africa; consisting of at least five residential units.

Residential unit:

* Any self contained unit of at least one room (excluding a hotel or hostel),
* ERECTED after 1 April 1982 and as part of a housing project as defined above,
* To be let out to a tenant for deriving profit or to be used by any “bona fide” employee of the taxpayer.

Basically, if you built the units and there were more than five of them, each being self contained and were renting them out; you could claim the tax deduction on the costs of the building. This was very good news for investors with lots of capital that were looking for rental income opportunities.

Unfortunately, there is now bad news.

As some may already know, the tax act is very subject to change. Section 13ter has been amended.

Having read the first two articles, you should now have a good understanding of the concept of “crossing the Rubicon”. In this article, I give several court case examples which dealt with the more intricate issues and helped to assess intention.

As we previously explained, the “Lydenberg” case stated that intention is the golden rule and hence, a court must look at the intention of the taxpayer when deciding the nature of a transaction. The moment the intention has changed, the taxpayer has “crossed the Rubicon” and the nature of the transaction changes.

What is Cost of Capital and Gearing

A very important concept to look at when investing is your cost of capital. All companies and investors need money in order to start or expand activities; this money comes at a price. Large companies usually have more complex structures, comprising of both funds generated through debt and issuing of equity instruments (such as shares or bonds).

However, the small property investor is usually only worried about two facets: the original capital invested in the company and any bonds applicable to the property. This cost is therefore easy to calculate. If you have a bond against an investment property of 15% per year, the cost is 15%.

In the property market, this tax principal is applicable when determining whether your property is a capital purchase; in a buy-to-let or a long-term purchase; and hence subject to only CGT upon sale.

To Understand “Capital Vs Revenue” purchases, one must first understand one basic principle. The “Fruit and Tree” principle is most important. The capital asset is the tree; it is kept in order to obtain the fruit and not sold in the short term.

Cash Flow Analysis 2 of 2 Evaluating and managing projects and Finance

In the previous article, I spoke about the importance of cash flow and the discounting thereof.

The next step is to identify the relevant cash flows. Firstly; what is a relevant cash flow?

A cash flow will be relevant if it can be changed or altered by a future decision. For example; if you choose to buy a building, you will make rental income, but, you can also choose not to buy it and therefore not receive rental income. An irrelevant cash flow cannot be altered by a future decision. For example; if you own the building you will have to pay rates and taxes whether you rent it out or not, you cannot make the decision not to pay as long as you still own the building.

So, where to start? Firstly, decide what your plan of action will be.

What asset are you buying?

What cash generating purpose will it serve?

How long do you intend to keep it?

Then identify the costs and the income flows related to each step. Things such as: income, rates, general expenses in the production of income, selling price at the end of its useful life and most importantly, the tax implications. The tax implications must be analysed on the sale, the income generated and the expenses. Most of these figures will have to be estimated from current market data and capital growth potential of the asset. Notice that we do not take into account interest or loan re-payments; these are factors of our cost of finance and your degree of affordability and are taken into account in our discount rate.

The next step is to identify when you will incur these costs. Some costs are incurred yearly whereas others are only incurred once or twice during the life of the asset.

Residential property predicted to decline further

It was brought to our attention that there are even more predictions about residential real estate going down for another 2 years or more.

Can this be true?

As with any prediction, it can be true as much as it can be wrong. But, in essence for real estate / property investors that have purchased correctly – this does not matter at all. Never did and probably never will.

Sure any investor can buy one or two wrong properties in their portfolio that don’t make much money, but one “sour lemon” has never been the “end of days” for any real estate investor.

Unless, of course there is the “but” again, and the “unless” again…. those are the only properties that the investor holds. Then this could be a big problem.

So, why in essence it doesn’t matter where the market goes?

Re-Financing your property

Often, people who own investment, or even private properties, re-finance without calculating the cost involved or having a proper understanding of the situation.
What is a re-finance agreement?

When you first submit a request for a bond on a property, the bank assesses the value of the property you wish to buy and grants you the bond at the fair market value of that property. So, suppose you wish to buy a house for one million, the bank will offer you one million, depending on your affordability. They offer you this amount because, should you default on your debt, they can repossess the property and sell it at that fair value, thereby getting back their money. This represents very little risk to the bank. However if the property market in the area is in decline – then this would be very big risk to the bank as the bond given won’t cover the selling price they can get (should they need to repossess).

Often, the value of property increases. Suppose that house is now worth 1.2 million. Should the bank repossess the property, they could probably get 1.2 million for it when they sell it. Therefore, the bank offers you a loan extension (an increase in your maximum loan) of 200,000. You can therefore take out a further loan of 200,000, using the property as collateral.

What people must bear in mind is that this is not money in your pocket; it is an increase in the loan amount of 200,000 which will have to be re-paid over the lifetime of that bond. Most people believe that it is money they simply receive and can therefore use to either lower their bond or for personal use. The simple fact is that the value of the asset which is up as collateral, namely the house, has increased and the bank therefore extends you a possible increase in the loan amount.

It is sad see that there are many property investors and home owners that can’t pay their bonds due to the recent interest rate increases. To add to the trauma, many have refinanced properties to the extent that getting a quick sale in the open market is close to impossible as there is no equity left to make the deal attractive to another investor.

This makes the situation very unpleasant and dangerous for the credit records of such persons. These incidents seem to leave the property investor or homeowner stuck, panicked and very emotional about the situation.

What Does Connected Person Mean in Tax

Recently on PIN Forum there has been a discussion about “round trip financing” and the dangers related to this. If you wish to read the thread before you read this article it can be found here .

As a general summary, the problem for investors is when the start moving around money between people that are the same, or in other words connected persons and /or entities.

This falls under some heavy issues discussed in that thread about “round trip financing” with no commercial substance and much more. Section 80 of the income tax act no 58 of 1962 says in detail what a tax avoidance agreement is. The act deals with sections such as lack of commercial substance and round trip financing, both of which are clearly identifiable in this cases of connected persons.

In several of my articles I will be discussing special rules for connected persons. I therefore feel it is important to mention what a connected person is, for tax purposes.

The act separates connected persons in relation to individuals, companies, members of partnerships and trusts.

Section 13 Tax Allowances in respect of Residential Buildings

Most investors know that in South Africa, as opposed to other countries like the US, property investors cannot depreciate residential buildings. We all know that some changes have been made to allow depreciation on commercial buildings but residential buildings according to tax law doesn’t have many options. As you noticed, I said many options, there is though one option in the law that is somewhat constrictive, but which may still be a viable option for buy to let investors. Interest Rates Up Again Brewing the Perfect Storm

The long speculated market downturn is undeniably here. No need to speculate, it's on the streets and creating havoc. The stage is set for the perfect storm.

Private Property vs Estate Agents and Facebook in The Mix

Once in a while like in every industry we need to look into the future to plan our marketing and continued growth. The Real Estate agents industry should do that now. I wrote a while ago that real estate agents should start looking into the future while taking new communications and networking methods into account.

In every industry once in a while there are changes that have major future affect on how we do business. I remember the days when some people refused to carry a cell phone. Look today where we are. Even a 7 year old child carries and owns a cell phone. People are even becoming phobic without their cell phones, like it is their life line. What did we ever do before cell phones?

I don’t know if this is good or bad nor do I care to criticize, but what is important is that I have noticed a change in the way people are marketing property to one another; a change that has the potential to be as significant as the cell phones, if not even more. Because it connects people instantly and only people that wish to be connected to each other in this communication medium, much like the cell phones.

Yes, I am talking about the social networks and the move into social networking in the property space. When I speak to agents about social networking, they look at me in with a funny look, either I am mad, or they have no clue what I am talking about. This makes me seriously wonder.

Today social networking and social media is growing by leaps and bounds, monthly, not yearly. Take into consideration that Facebook since 2004 has acquired some 64 million users and I also heard a report that some 250,000 users are joining monthly. That is just beyond amazing.

But what does this have to do with real estate agents, property and Private Property?

Do buy to let cashflow positive property deals exist right now?

This is one of the most frequently asked questions we got througout this year (2007) from property investors in the residential buy to let market. It is very interesting to note, that before the increase in interest rates, this question was not often asked. It was like property investors either took it for granted that cash flow positive properties just did not exist, or that the difference between the bond repayment and rental did not really bother them based on handsome equity growth.

As interest rates started increasing, so did the frequency at which the question, “Are there any cash flow positive properties?” got asked.

So do they exist?
